Peachit Terms of Service

Eligibility

Minimum Age Requirement

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to create an account and use the Service. If you are under 18 but at least 13 years old, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. Individuals under 13 are strictly prohibited from using the Service.

Legal Capacity

You affirm that you have the full legal capacity and authority to enter into this agreement, whether on your own behalf or on behalf of an organization, company, or entity. If you are registering on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Account Registration and Security

Account Creation

To access and use certain features of the “Service”, you may be required to create an account by providing a valid email address, username, and secure password. By registering, you represent and warrant that all information provided is accurate, complete, and up-to-date. Failure to provide accurate information may result in suspension or termination of your account.

Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree not to share your account credentials with any third party and to notify Peachit immediately of any unauthorized access or suspected security breach. We are not responsible for any loss or damage arising from your failure to maintain the security of your account.

Subscription & Payment

Subscription Plans

Peachit offers the following subscription plans designed to meet different user needs:

• Solo Plan: For single-user projects:
  • $1.90 per month, billed monthly.
  • $19 per year, billed annually (16% discount compared to monthly billing).
  • Includes a 14-day free trial with no upfront credit card required.

Free Trial for Solo Plan

The Solo plan includes a 14-day free trial with access to all features. No credit card is required to start the trial. After the trial ends, a paid subscription is required to continue using the Service.

Billing & Payments

Payments for Peachit subscriptions are processed securely via our third-party payment provider. By subscribing, users authorize Peachit to charge their selected payment method automatically at the start of each billing cycle (monthly or annually). All payments are non-refundable except as required by law.

• If a payment fails, access to Peachit may be suspended until the issue is resolved.
• Subscription fees do not include taxes, which may apply based on the user's location.

Renewal & Cancellation

Subscriptions automatically renew unless canceled by the user before the next billing cycle. Users can cancel anytime via their account settings.

• Cancellations take effect at the end of the current billing period.
• No refunds or prorated credits are issued for unused portions of a billing cycle.

Pricing Changes

Peachit reserves the right to modify subscription pricing. Users will be notified at least 30 days in advance of any pricing changes, which will apply upon the next billing cycle.

Refund Policy

Payments for subscriptions are non-refundable. Users are responsible for canceling their subscription before renewal if they do not wish to continue.

• No refunds are issued for accounts terminated due to violations of our Terms of Service.

User Conduct

Acceptable Use

When using Peachit, you agree to adhere to ethical and lawful behavior. You are responsible for all content you create, share, or interact with on the platform.

• Respect others by not engaging in harassment, hate speech, or discrimination.
• Ensure that all uploaded content is legal, non-defamatory, and non-threatening.
• Use Peachit only for its intended purpose and refrain from abusing features.

Prohibited Activities

The following actions are strictly prohibited and may result in suspension or termination of your account:

• Uploading, sharing, or promoting illegal, obscene, or offensive content.
• Attempting to hack, disrupt, or exploit vulnerabilities in Peachit.
• Impersonating another user, entity, or falsely representing affiliations.
• Using automated systems (bots, scrapers) to manipulate the service.
• Engaging in spam, phishing, or fraudulent activities.

Enforcement

Peachit reserves the right to investigate and take necessary action if a user violates these conduct guidelines. This may include warning, suspension, or permanent account termination.

• Violations may be reported to the appropriate authorities if required.
• Peachit reserves the right to remove content that breaches these Terms.
• Users may appeal enforcement decisions through our support team.

Content Ownership & Licensing

User-Generated Content

Peachit allows users to create, upload, and share presentations material, documents, and other content ("User Content'). You retain all ownership rights to the User Content you create and submit through Peachit.

License Grant to Peachit

By uploading or creating User Content on Peachit, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, store, reproduce, distribute, modify, publicly display, and perform your content solely for the purpose of operating, improving, and promoting the Peachit platform and services.

User Responsibilities

• You confirm that you have the necessary rights to upload and use the content.
• You agree not to upload content that infringes on third-party copyrights, trademarks, or intellectual property rights.
• You acknowledge that Peachit does not claim ownership over your content but requires a license to provide its services effectively.

Content Removal & Termination

If you delete your User Content or terminate your account, the license granted to Peachit will automatically expire, except where retention is required by law or for legitimate business purposes (such as backups, compliance, or dispute resolution).

Intellectual Property

Ownership of Content

Peachit and its associated trademarks, logos, software, and all content provided within the platform (excluding user-generated content) are the exclusive property of Peachit or its licensors. All intellectual property rights are reserved.

Restrictions

• Users may not copy, modify, distribute, or reverse-engineer any part of Peachit’s platform.
• Users may not use Peachit’s trademarks, branding, or copyrighted material without prior written consent.
• Any unauthorized use of Peachit’s intellectual property may result in legal action.

Service Availability & Downtime

Peachit aims to provide a reliable and accessible service, but we do not guarantee uninterrupted availability. Scheduled maintenance and unforeseen technical issues may cause downtime.

• We strive for a 99.9% uptime but do not guarantee it.
• Planned maintenance will be communicated in advance.
• We are not liable for any business losses due to downtime.

Privacy Policy Reference

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information.

Termination & Suspension

Peachit reserves the right to suspend or terminate your access if you violate these Terms or engage in harmful activities.

• Accounts can be suspended for policy violations or misuse.
• Termination may occur without prior notice in severe cases.
• Users may request to delete their accounts at any time. Upon receiving a deletion request, Peachit will deactivate the account immediately, but user data will be retained for 30 days before permanent deletion. This retention period allows users to recover their accounts if requested and ensures compliance with legal or operational requirements. After 30 days, all user data will be irreversibly deleted, except where retention is required by law.

Disclaimer of Warranties

Peachit provides the service "as is" without warranties of any kind. We do not guarantee that our service will be error-free, uninterrupted, or fit for a particular purpose.

• Service is provided without express or implied warranties.
• Peachit is not responsible for data loss or security breaches.

Limitation of Liability

To the maximum extent permitted by law, Peachit shall not be liable for indirect damages, including loss of profits, data, or business opportunities.

• Liability is capped at the amount paid for the service in the last 12 months.
• No liability for indirect, incidental, or consequential damages.

Indemnification

You agree to indemnify and hold Peachit harmless from claims, damages, or expenses arising from your use of the service.

• Users bear responsibility for legal consequences of misuse.
• Peachit is not liable for legal claims resulting from user actions.

Third-Party Services & Links

Peachit may provide links to third-party services, but we are not responsible for their content or policies.

• Users interact with third-party services at their own risk.
• We do not endorse or guarantee third-party integrations.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law principles.

Any disputes arising from or related to these Terms, the use of Peachit, or any related services shall be subject to the exclusive jurisdiction of the courts located in Greece. By using Peachit, you agree to submit to the personal jurisdiction of these courts.

Before initiating legal proceedings, parties agree to attempt to resolve disputes amicably through negotiation. If a resolution cannot be reached, disputes may be settled through arbitration or litigation, as permitted under Greek law.

Changes to Terms

Peachit may update these Terms periodically. Continued use after changes means acceptance.

• Users will be notified of major changes.
• Regular review of Terms is recommended.
